摘要
通过追溯行政协议识别标准的讨论,发现“内容要素”是界定PPP项目中行政协议的核心标准,提出以三类主要的PPP协议为突破口,从行政机关的“授益性质”维度对三类PPP协议中行政机关的主要义务进行解析,得出尚未被定性的外包类PPP协议和私有化类PPP协议应属于民事协议的结论,并建议在未来的PPP协议纠纷裁判中,以对行政权力的监督和公共利益的维护为出发点考虑诉讼路径。
Through retrospecting to the discussions of the definition of administrative agreements,this paper finds that the"content element"is the key standard to recognize the administrative agreement in PPP program,and proposes to set the three main PPP agreements as breakthrough.From the perspectives of the government's"giving benefits nature",the paper analyzes the administrative organs'obligations in the three types of PPP agreements and then get the conclusion that undetermined types of epiboly and privatization PPP agreements belong to the civil contract and it is suggested that we should consider the supervision of administrative power and the maintenance of public interest as the starting point of litigation path in the future to judge disputations of PPP agreements.
