摘要
由于破产数据资产具有全球性、敏感性和跨境破产导致数据集中的特点,应当对破产程序中的数据跨境流动进行规制。我国简单而分散的规制方式不利于推进破产程序和保障数据安全。我国现有破产程序中的数据跨境流动规制存在几个方面的不足,包括多重目标之间的冲突未协调、可跨境交易数据资产确定难、数据资产跨境交易条件规制不足、救济模式不能适应破产情境和跨境破产数据共享机制缺失。我国应根据国情,完善破产程序中的数据跨境流动规制,以数据安全保障与破产程序相协调和多层次、多角度规制为基础,增强破产法律和非破产法律规制的一致性和协同性;明确破产中可跨境交易数据资产的范围;完善数据跨境交易的多重规制;完善违反数据保护义务行为的救济模式;积极构建跨境破产程序中的数据共享机制。
Due to the global nature,sensitivity,and data concentration characteristks of cross-border bankruptcy,it is necessary to regulatethe cross-border data flows in bankruptcy proceedings.The simple and fragmented regulatory approach in China is not conducive to advancing bankruptey Proocedingsand ensuring data security.There are deficiencies in the cur-rent regulation of cross-border data flows in China's bankruptcy proedures.including uncoordinated conflkts among multiple objectives,difficulties in determining data assets eligible for cross-border transactions,insufficent regulation of con-ditions for cross-border data transactions,inadequate remedies that do not fit bankruptcy scenarios,and the lack of a sharing mochanism for cross-border bankruptcy data.China should improve the regulation of cross-border data flows in bankruptcy proceedings according to its national conditions.based en the coordination between data security protoction and bankruptcyProcedures with multi-level and multiangle regulation.Specific measures include enhancing the consistency and coordination between bankruptcy and non-bankruptcy laws and regulations,clearly defining the scope of data assets eligible for cross-bor-der transactions during bankruptcy,improving the multiple regulations governing cross-border data transactions,refining the remedy modes for breaches of data protection obligations,and actively establishing a data-sharing mechanism in cross-border bankruptcy Proceedings.
