摘要
纪检监察机关是党和国家监督专责机关,监督是纪检监察机关的第一职责、基本职责,因此研究其监督功能及其价值,是纪检监察的核心要义。纪检检察监督是党和国家监督的重中之重,既包括内部监督也包括外部监督,既包括党纪监督也包括国法监督,既包括政治监督也包括对执纪、执法人员滥用权力的监督,既包括对职务违纪、违法和犯罪的调查监督也包括对公职人员滥用职权和玩忽职守的监督,既包括事前、事中监督也包括事后监督等。其功能价值包括制度功能价值、机制效能价值、人才贤能价值、协作能动价值等。监督理论与实践的体系性能最大程度地发挥纪检监察监督的效能与效益,前者是纪委监委通过认真履行监督职责不断提升全面监督的质效与功能,后者是在纪检监察监督运行中,既要考虑到整个监督的一体化推进又要抓住监督的关键进行重点发力,从有效机制上保障纪检检察监督的效果和收益,为建设中国特色社会主义法治国家保驾护航。
Discipline inspection and discipline supervision agencies are the institutions for supervising the Communist Party of China and the State,and supervision is the first and basic duty of discipline inspection and discipline supervision agencies,so studying their supervisory function and its value is the core essence of discipline inspection and discipline supervision.Discipline inspection and supervision is the top priority of the CPC and the State supervision,which includes both internal and external supervision,both CPC discipline supervision and State law supervision,both political supervision and supervision of abuse of power by disciplinary and law enforcement officials,both investigation and supervision of violations,misdemeanours and crimes,and supervision of abuse of power and dereliction of duty by officials.It includes supervision before,during and after the event.Its functional value includes the value of institutional function,the value of institutional effectiveness,the value of talents and the value of cooperation.The systematic performance of supervision theory and practice can maximise the efficacy and effectiveness of discipline inspection and supervision.The former is that the CCDI and the NCS continue to improve the quality and function of comprehensive supervision by conscientiously fulflling their supervisory duties,and the latter means that in the operation of discipline inspection and supervision,it is necessary to take into account the integrated promotion of the whole supervision as well as seize the key points of supervision to carry out key efforts,and safeguard the effects and benefits of discipline inspection and supervision from an effective mechanism.The efforts are to escort the construction of a socialist country under the rule of law with Chinese characteristics.
