摘要
检察听证系国家治理体系与治理能力现代化建设背景下发展起来的新兴制度,践行以人民为中心、维护社会公益、能动司法以实现源头治理,提升检察机关参与社会治理水准。检察听证功能呈多元化,其中司法决策透明与公民有效参与构成制度主要功能。相较其他类型听证制度,检察听证重心在于审判前程序,制度属性体现为听证内容的综合性与结果的程序性。听证主体、基础及功能要件构成听证程序运行机制,程序机制要素的不同组合形成检察机关主导的复合听证模式。
Prosecutorial hearing is an emerging system developed under the background of the modernization of the national governance system and governance capacity.It practices people-centeredness,safeguards social public welfare,and takes active judicial actions to achieve source governance and improve the level of procuratorial organs’participation in social governance.Its functions are diversified.Among them,transparent judicial decision-making and effective citizen participation constitute the main ones of the system.Compared with other types of hearing systems,the focus of prosecutorial hearing is on the pretrial procedure,and the institutional attribute is reflected in the comprehensiveness of the hearing content.The hearing subject,basis and functional elements constitute the operating mechanism of the hearing procedure.Different combinations of procedural mechanism elements form a composite hearing model led by procuratorial organs.
