摘要
公共数据呈现“公共生产-公共消费”的新结构,流通配置公共数据中的国家与市场二元对立进一步消解。培育一体化公共数据市场的法律治理转型路径应当坚持人民立场导向、经济价值创造与公共利益实现,以法律客体变革牵动法律主体与法律关系改变,在客体上建构财产到数据的新规则,由新型治理推动塑造共生性关系。数据公共产品供给需要新的制度供给,以均衡发展为旨要,以优化授权运营为支柱,坚持共建共治共享的多维治理体系,建设全国一体化数据市场,引入数据驱动的科技监管范式。
Public data presents a new structure of"public production-public consumption",and the binary opposition between the state and the market in the circulation and allocation of public data is further dissolved.The transformation path of legal governance to cultivate the integrated public data market should adhere to the orientation of the people's position,the creation of economic value and the realization of public interest,influence the change of legal subject and legal relationship with the change of legal object,construct new rules of property to data on the object,and shape the symbiotic relationship by the new governance.The supply of data public goods requires a new institutional supply,with balanced development as the purpose,optimization of authorized operations as the pillar,with adherence to a multi-dimensional governance system of co-construction,co-governance and sharing,for the construction of a national integrated data market,and with the introduction of a data-driven technology regulatory paradigm.
