摘要
京津冀协同发展作为国家战略,其运行和实施必然会产生大量新型的社会关系,亟须立法加以规范。联合立法机制可以有效满足并适应这一需求,通过不改变现行立法体制的联合会商、确立统一原则和标准后分头立法的柔性联合立法模式,虽可以担负一定的立法职责,但从长远来看,还需建立刚性联合立法模式,消除协商立法机制不可避免的"扯皮"和"拖耗"现象,降低重复立法产生的资源浪费和成本支出,使相关立法更有力、更到位,在实施环节更加有效。这就需要改革现行立法体制,提升立法层级,以确保相关立法的权威和稳定,更好地维护、调整和推进京津冀协同发展有序运行。
As a national strategy,the joint development of Beijing,Tianjin and Hebei needs a joint legislation to regulate some new- typed social relationships. In a short time,Beijing,Tianjin and Hebei can discuss together to establish the legislative principle and criteria and then to make laws respectively,but in a long time a rigid joint legislative model will be established to avoid 'passing'and 'drag consumption'and to make legislation more powerful,proper and effective,which needs to deepen and reform the existing legislative system and upgrade the stratum of legislation to ensure that the joint development of Beijing,Tianjin and Hebei may go in a stable and smooth way.
