摘要
在现代社会,行政公权力以国家强制力做后盾,更有利于保障国家利益和社会公共利益。但公权力的强制力如果运用不好,也会对公民的合法权利造成损害。党的十八大提出,要"推进依法行政,切实做到严格公正文明执法。"这为加强对行政公权力的监督制约指明了方向。行政公权力对私权的侵害已然成为阻碍我国法制建设的顽疾,必须加强意识形态领域和相关制度的建设,为行政公权力的合法行使提供强大的法律支撑,实现行政公权力和公民私权的平衡发展。
In the modern society, relying on the state compulsive power, the administration public rights are advantageous to guarantee national interest and social public benefits. But if the compulsive power of the public rights can not be used properly, it will also bring damage to the legal right of the citizens. The 18th Congress of CPC calls on pushing forward administration by law and enforcing laws fairly, which indicates the direction for supervision over public rights. The violation of administration public rights on private rights, has already become a clag in the construction of national legal system. We should strengthen the of construction of ideology and related systems, provide legal support for proper public administration right, and realize the balance between administration public rights and citizen private rights.
