摘要
2014年司法判决的实证数据显示,拒不支付劳动报酬罪在我国当下的适用呈现出总体适用比例过少、各地司法机关在定罪量刑上差异过大的不良状况。而造成如此状况的原因在于:对拒不支付劳动报酬行为入罪的合理性、如何区分欠薪纠纷中的民刑交叉问题存在争议;同时,"支付能力""责令支付"等构成要件在理解上也存在分歧。拒不支付劳动报酬的行为在现实中可能导致严重的危害性,应肯定该罪存在的合理性,并且应以欠薪者的"主观恶性"大小作为区分民、刑案件的标准;此外,应通过对欠薪者财产的联合查处、加强法律宣传等手段,完善该罪名在实践中的运用。

Anyhow, the existence of the charge should be affirmed, and the offender should be convicted according to its subjective. In addition, we should strengthen the investigation and legal advocacy.
