摘要
在保障法定机构自主运行的同时又要实现对它的有效监管,是我国推进法定机构试点必须要考虑的一项重要内容。为了保障法定机构的公益性,各国、各地区都采取了相关的监督措施,英国以"适距控制"和框架文件为监管基础,香港地区则发展形成了多层次、多方面的内外部监督机制,广东省在试点过程中也强调监督机制的建立与完善。通过借鉴国内外的有关经验,逐步探索建立科学有效的监管机制,应当以"法定"为监管机制的基础,引入"适距控制"原则,从运作监管、人事监管、财政监管、社会监管等方面构建多层次的内外部监督机制。
In order to ensure the independent operation of statutory board,and to achieve effective supervision,it is an important content that we must consider in promoting the pilot of the statutory board.In order to protect the public welfare of statutory board,all countries(regions) have adopted the supervision measures,for example,the British regulate on the'appropriate distance control'and the framework document,Hongkong formed a multi-level supervision mechanism during the development,and Guangdong also emphasized to establish and perfect the supervision mechanism.By drawing on relevant experience at home and abroad,we should gradually establish a scientific and effective monitoring mechanism,which on the basis of legal supervision mechanism,the introduction of'proper distance control'principle,to build a multi-level supervision mechanism inside and outside from the operation of supervision,personnel supervision,financial supervision,social supervision etc..
