摘要
“法治”不同于“法制”和“依法治国” ,它的实质是一种正义、自由精神 ,而这种精神与伦理道德的价值追求是一致的。法治精神的外化即法律的基础在于伦理道德原则 ,不论是其合理性还是其秩序的建立 ,都要以伦理道德为保证 ,而且法治的具体实施即立法、执法和守法更是需要道德的支撑。
Rule by Law” differs from “Legal System” and “Govern the country according to law”. Its essence is a spirit of justice and freedom, which is identical with the moral value. The appearance of “Rule by Law” law, bases on the ethic principle. Either the rationality or the establishment of order of “Rule by Law” should be assured by the morality. The specific implements, such as legislation, enforcing law and abiding by law need deeply the support of morality.
