摘要
目前存在的农地自发入市现象 ,导致事实上的城市土地价格双轨制和隐性土地市场。其根本原因在于农村集体土地立法和管理体制的缺陷。为解决这一问题 ,应当通过改革农村集体土地使用权 ,在所有权不变的前提下 ,允许使用权流转 ,建立城乡统一的土地市场 ;改革征地制度 ,明确征地的性质和使用权 ;改革征地补偿标准。
This paper analyzes the aftermath of spontaneous flow of rural collective land into market and reveals that spontaneous flow of rural collective land into market results in the settled fact of urban land price double tracks system and invisible land market.To solve this problem, the author maintains that, firstly, ascertain the owner of rural collective-owned construction land ownership; secondly, through reform of rural collective construction land use right, under the premise that ownership remains unchanged, allow land use right to go into circulation, make innovation of the rural collective construction land circulation system;thirdly, establish the administration mode of “two property rights without indiscrimination in one market”;lastly, bring collective use land in the boundary of suburban area and downtown area into city construction land reserve system.
