摘要
随着数字化时代的来临,以网络为载体进行的信息传播呈现迅猛发展的趋势。这一变化给传统法律带来了诸多新问题,在著作权保护方面表现得尤为突出。加强对网络环境下著作权保护,是时代发展的要求,也是利益平衡的体现。明确网络侵权的归责原则和司法管辖,明确合理使用的范围,完善著作权集体管理制度,是目前加强网络环境下著作权保护可行和有益的做法。
With the coming of the digital times, information dissemination which takes network as its carrier presents a rapid adeveloping trend. This change has brought many new issues to the traditional legal system, particularly on copyright protection. To strengthen copyright protection under the network environment is the requirement of the times, but also a reflection of the balance of interests. To definite the criterion of liability and judicial jurisdiction of internet infringement, to clear the scope of the reasonable use of copyright, and to perfect the system of collective management of copyright, are feasible and useful practices to strengthen copyright protection under the network environment.
