摘要
南海地区安全合作机制的建立与维护是中国在全球推动建设以"合作共赢"为核心的新型国际关系的缩影与样本。与国际法治不同,全球治理依据但不限于国际法,而国际法治虽相对独立于全球治理但又受后者深刻塑造。相对国际法治而言,在全球治理领域,中国的策略选择空间与利益更大。以南海仲裁案为核心的国际法律战是美国在南海地区实行"成本强加战略"破坏中国主导的南海地区治理秩序的战略的一部分。南海地区安全合作机制建立在中国作为定义一方主导的全球治理及国际法治以及中国与东盟国家基于"一带一路"而形成的市场一体化的基础之上,而南海地区安全合作机制应以程序化机制为优先建设目标。
The founding and further development of the security cooperation mechanism in South China Sea is an example and miniature for China to establish a kind of new international relationship based on the conception of "win-win cooperation"around the globe. Compared with the rule of international law,the extension of global governance embraces more than international law,while the rule of international law is independent from global governance to some extent but the former is influenced greatly by the latter. In the existing area for the rule of international law,China's national strength,influence and potentials serve as an advantage as well as a disadvantage for China's choice of diplomatic strategy,whereas in the sphere of global governance,there exists more space and interests for China's choice of diplomatic strategy. In the South China Sea,the US employs a strategy of cost imposition against China,and the judicial confrontation centered on the SCS arbitration is only a part of such a strategy,which is embraced by the global governance defined by the US authorities. The SCS security cooperation mechanism shall be constructed on the basis of global governance and rule of international law initiated by China as well as that of market integration between China and the ASEAN developed by the BRI,and such a cooperation mechanism shall attach a high priority to the procedural institutions.
