摘要
相较行政权或司法权的性质视角,执行功能视角更能准确定位执行权。执行权的功能由执行程序启动、执行查控、执行标的实体权益判断、执行标的变价交付、执行救济裁判五部分组成。执行程序启动权、执行标的实体权益判断权、执行救济裁判权只能由法院行使,能够'外分'的只有执行查控权和执行标的变价交付权。执行难和执行乱的症结对应在执行查控权、执行标的变价交付权上,可分别通过建立信息化的执行查控系统、法院自主网络司法拍卖加以解决。该两项权能配置缺陷弥补后,审执分离的配置重心将转移到执行程序启动权、查控标的实体权益判断权、执行救济裁判权的建设上,完善执行标的实体权益判断权为审执分离方案的远期建设核心。
Execution power can be positioned more accurately by its commission than by its nature.The commission of the execution power consists of starting execution procedure,checking-and-controlling of execution,substantial interest decision of execution objectives,selling or delivery of execution objectives,and relief judgment of execution.The commission to start execution procedure,to decide substantial interest of execution objectives,to judge relief of execution should only be exercised by the court,so it is the commission to check-and-control of execution and to sell or delivery of execution objectives that can be performed'externally'.The difficulties of execution can be resolved by the establishment of an information-based platform to inspect and control because the crux is in the commission to check-and-control of execution,and the chaos of execution can be resolved by the establishment of independent network judicial auction because the crux is in the commission to sell or delivery of execution objectives.The two defects of commission configuration to be made up,the reform focus of execution power will be transferred to the construction of commission to start execution procedure,to decide substantial interest of execution objectives,to judge execution relief of execution.It is the core program in the longterm construction of the separation of executive power reform to improve the commission to decide substantial interest of execution objectives.
