摘要
金融问题涉及政治、经济、社会、人类行为等多个领域,如果仅仅从法律层面出发,并不能使滋生犯罪的诸多时代元素与作为犯罪治理手段的刑事检察很好地相互适应。在金融检察过程中,没有对滋生金融犯罪的社会全要素进行深入研究和认真审视,终究会与金融犯罪治理产生适应性背离。反思现行金融检察社会功能的缺陷,强化社会功能实现,应着重优化金融检察在体制改革、社会治理、创制规则、塑造文化等方面功能。
Financial problems involve political, economic, social, human behavior and other aspects. From a legal perspective, prosecutors cannot afford good resolution. Financial crime governance faces difficulties. Comprehensive financial prosecutor should be carried out. Social function of financial prosecutor is to be reviewed and optimized, especially in fields of reform, governance, rules and culture.
