摘要
《1993商事代理条例》[the Commercial Agents(Counci Directive)Regulations 1993]颁布前,代理人 与委托人之间的权利义务关系主要通过合同条款和英国公法调整。《条例》的颁布与实施,对英 国商事代理人的权利与义务产生了很大影响,尤其在合同终止后的获赔权方面,给商事代理人提 供了更好的法律保护。但《条例》中的某些条款给司法实践带来了很大的不确定性,从而影响了 对商事代理人的保护力度。
Prior to the enactment of the Commercial Agents( Council Directive) Regulations 1993, the legal relationship between the agent and the principal was mainly regulated and governed by contractual provisions and English common law. The enactment and implementation of the 1993 Regulations have a great effect on the rights and obligations of commercial agents. It provides the commercial agents with better legal protection, especially in respect of the right on termination. However, some provisions of the Regulations bring about some uncertainty in judicial practice and thus affect the effectiveness of a-gent protection.
