摘要
专利制度对企业技术创新行为的影响是一个极其复杂问题。本文从专利保护期的角度 (或者说以专利保护期限为约束条件 ,或者以专利保护期以变量 ) ,研究了专利保护期对企业收益以及由扩散效应引发的社会收益的影响 ,建立最大化社会净收益的优化模型 ,并推出一系列有意义的结论 ,同时给出其政策意义。
The effect on technological innovation caused by patent system is a complex problem. From the point view of patent life ( or we say, patent life is regarded as a restriction or a variable), this paper considers how the patent life affects the revenue of the corporation and that of the society caused by the expanding effect. The optimal model for maximizing the net revenue of the whole society is established, and some important conclusions and policy implication are presented.
