摘要
地理标志是一项重要的知识产权,国际社会缔结了专门的国际公约对地理标志进行保 护。国外立法主要采用商标法、专门立法和反不正当竞争法三种模式保护地理标志。我国地理标志 保护体制需要进一步完善,应构建适合我国国情的地理标志保护框架。
The geographical indication is an importam intellectual property right. The International society concludes a special International treaty to protect the geographical indication. The foreign legislation protects it by use of such three modes as trade mark law, special law and unfair competition law. It is necessary for us to further perfect the geographic indication, set up the protect framework for the geographic indication that conforms to the situation of our country.
