摘要
生育权的法律属性是生育权制度研究的基本问题 ,在生育权的法律属性上 ,可谓仁者见仁 ,智者见智。本文在综合论述生育权的基础上得出 :生育权是公民人身权中的一种身份权 。
One basic concern of the reproductive right system is the nature of reproductive right, on which different and even controversial views have been expressed. Based on comprehensive examining of reproductive right, the author concludes that the reproductive right is an identity right, one of the personal rights of a citizen, which is mutually and equally enjoyed by the two partners in cojugal relation.
