摘要
罗马私犯法以其丰富的法制内容和深邃的法治理念对后世的侵权行为法产生巨大影响。法、德民法典中的侵权行为法直接继承和发展了罗马私犯法的精髓。深入探究罗马私犯法所蕴藏的法律精神,重温罗马私犯法的基本制度和罗马法学家对私犯法的精辟论述,对当今中国民法典侵权制度的确立与完善具有借鉴意义。
Private delict law in Rome exerts an influence on tort of later generations because of its
abundant legal system and profound theory. Tort in French and German civil code has inherited and
developed the spirit of Rome private delict law. Researching the law spirit of Rome private delict law, the
basic rules of Rome private delict law and brilliant expression on private law which given hy the Rome
jurist will contribute a lot to the establishment and perfection of the tort system of China.
