摘要
代位权诉讼制度确立至今已经四年 ,但由于该制度存在许多不完善之处 ,学界相关的讨论至今仍未停止。本文对代位权诉讼的若干问题作简要的探讨 ,在指出存在的问题的同时 ,提出了一些立法和司法建议。
Subrogation Suit institution was established four years ago.Because there exist a lot of defects of this institution,the relevant debating has never ceased.This article gives a brief probe into several issues of Subrogation Suit,points out the problems and raises some suggestions.
