摘要
期待可能性理论作为一种刑法理论,目前已在西欧大陆法系国家及日本取得通说地位。若将该理论引入我国将对完善我国刑事立法、指导刑事司法具有重要意义。
The theory of expecting possibility, as one of criminal law theories, has been commonly accepted in the western European countries and Japan. If it is introduced to China, according to the basic theory of criminal formation in China, the theory of expecting possibility is a component part of criminal behavior capability. It is vital to perfect criminal legislation and instruct criminal judicature.
