摘要
内地与香港对劳动争议的处理,同样实行“一裁两审”的劳动争议仲裁体制,但在发挥作用方面,既有各自的优势,也有各自的不足。从两地劳动仲裁制度的法律规定、制度构建和机构的设置等方面进行比较,重新审视内地劳动仲裁制度的定位,探索建立以“仲裁为主,诉讼为辅”的科学高效,兼具中国特色的劳动仲裁制度具有十分重要的意义。
As the same as in Hongkong, the labor dispute arbitration system of 'one arbitration, two trials ' is also implemented in hinterland, while each has its own strong and weak points in function. So it is significant to compare the legal provisions, systematic construction and institutional establishment of the labor arbitration systems in hinterland and Hongkong, re-examine the orientation of the labor arbitration system inland and probe into establishing a scientific and efficient “relying on arbitration mainly and litigation subsidiarily”labor arbitration system with China characteristics.
