摘要
现行劳动争议与诉讼制度存在的问题已对及时、有效解决劳动纠纷产生了一定的不良影响。需要重新明确劳动争议仲裁委员会的法律地位,改革劳动争议处理先裁后审的模式,最终建立“或审或裁,一裁终局”的劳动争议处理模式。
The current system of arbitration and lawsuit on labor disputes are confronted with problems, which have posed negative influence on effective settlement of labor disputes. Therefore, the legal position of the labor arbitration committee should be defined and the model of 'lawsuit coming after arbitration' should be reformed. The paper proposes that either lawsuit or arbitration be the final settlement of labor disputes.
