摘要
我国农地承包经营权的物权化 ,不仅是理论研究已形成的共识 ,更是回应我国农地立法改革与农村经济发展实践的需要 ,被确立为一种基本的立法理念与制度设计思路 ,有其必然性、逻辑性与渐进性 ;回顾与展望这一历史进程并对其应然结构加以研究 。
The necessity of involving Right in Rem into the discussion of problems on Chinese Farmland Contracted Operating Right has been widely recognized by Chinese lawmakers and experts. This tendency also coincides with the requirement of the reforming process on Chinese farmland legislation and the rapid development of rural economy in China. Academic research in this field must be carried out to help propose useful ideas, contributing to the legislation on Chinese Farmland use in the modern society.
