数字化时代下,网络支付逐渐应用于人们的日常生活中,成为一种快捷服务。是以,扫码点餐这种新模式也随之诞生。纵观扫码点餐过程,带给消费者的不仅是由于扫码而带来的商家营销策略的困扰,更重要的是在强制扫码、强制授权等情况下对消费者权益的侵害,而且关于被收集的个人信息的流向由于网络监管的缺失在某种程度上变得“透明”,若被不法分子利用就会造成财产损失。总之,扫码点餐背后隐含着一系列法律风险,为了更好地规制扫码点餐的一系列乱象,避免消费者权益损害,商家应加强对网络点餐系统的维护与管理,承担起相应的义务与责任,立法者应建立健全网络支付法律规制体系,行政机关需加大执法和监管力度,司法机关依法监督保障消费者信息安全,同时消费者要提高自身安全防护意识和法律意识,积极运用法律手段维护自身权益。In the digital era, online payment is gradually being applied to people’s daily lives, becoming a fast service. Therefore, the new model of QR code ordering has also emerged. Throughout the process of QR code ordering, what brings consumers is not only the difficulties of marketing strategies caused by scanning, but more importantly, the infringement of consumer rights in situations such as mandatory scanning and authorization. Moreover, the flow of collected personal information has become “transparent” to some extent due to the lack of network supervision. If it is used by criminals, it will cause property losses. In short, there are a series of legal risks hidden behind QR code ordering. In order to better regulate the chaos of QR code ordering and avoid consumer rights and interests damage, businesses should strengthen the maintenance and management of online ordering systems, assume corresponding obligations and responsibilities. Legislators should establish a sound legal regulatory system for online payments, administrative agencies need to increase law enforcement and supervision, judicial agencies need to supervise and protect consumer information security in accordance with the law, and consumers should raise their awareness of security protection and legal awareness, actively use legal means to protect their own rights and interests.
