摘要
随着我国营商环境排名的上升,营商环境法治化构建成为了推动我国经济发展的有效制度保证。本文从市场监管的性质角度出发,通过剖析营商环境与市场监管的关联,探讨在市场监管过程中如何促进营商环境的构建。通过市场准入、市场退出、市场主体之间的竞争法律关系探讨,如何使得市场监管的路径更符合营商环境的法治化进程。行文中包含对政府与市场关系的探讨,以及政府如何在简政放权的政策下,有效发挥市场干预的作用。通过创新市场监管方式,为中国社会主义市场经济发展提供思路。
With the rise of the ranking of China’s state-owned business environment, the legal structure of business environment has been established to promote the effective system guarantee of China’s economic development. From the perspective of the nature of market supervision, this paper ana-lyzes the relationship between business environment and market supervision, and discusses how to promote the construction of business environment in the process of market supervision through the discussion of market access, market exit and competition legal relationship between market subjects, how to make the path of market supervision more in line with the legal process of business environment. The article includes the discussion of the relationship between the government and the market, and how the government can effectively play the role of market intervention under the policy of simplifying administration and delegating power. By innovating the way of market supervision, we can provide ideas for the development of China’s socialist market economy.
