摘要
关于惯常元素组合的成衣设计能否给予著作权法保护,我国《著作权法》未作规定,导致司法实践中出现同案不同判的现象。在现行法的框架下,如果惯常元素组合的成衣设计能够达到实用性与艺术性相分离,应当认定为“美术作品”。同时,如果这样的惯常元素组合的成衣设计表达系独立完成并且有创新性,创新性能在元素的组合方式、组合后的整体美感的其中一项有所体现的,应当认定为具有“独创性”,进而给予著作权法保护。从长远看,应当通过修订《著作权法》或出台司法解释,将成衣设计作为实用艺术品纳入著作权法的保护范围,并在司法审判中注意实用性与艺术性分离的判断方式和独创性的认定标准,对确有独创性的惯常元素组成的成衣设计,依法给予著作权法的保护。
There is no provision in China’s Copyright Law regarding whether the ready-made clothing design with customary element combinations can be protected by copyright law, leading to the phenomenon of different judgments in the same case in judicial practice. Under the current framework of law, if a ready-made clothing design that combines customary elements can achieve a separation of practicality and artistry, it should be recognized as a “work of art”. At the same time, if the expression of such habitual element combinations in ready-made clothing design is independently completed and innovative and the innovative performance is reflected in one of the combination methods of elements and the overall aesthetic feeling after combination, it should be recognized as having “originality” and given copyright law protection. In the long run, clothing design should be included in the protection scope of the copyright law as a practical work of art by revising the Copy-right Law or issuing a judicial interpretation and attention should be paid to the judgment method of separating practicality from artistry and the identification standard of originality in the judicial trial. Clothing design composed of customary elements that are truly original should be protected by the copyright law.
