随着我国经济由高速发展转向高质量发展,数字经济也爆发出巨大活力。依托于互联网技术的各类网络第三方平台相继出现并迅速扩张,给市场经济带来井喷式电子商务服务或买卖交易的同时,也引发一系列的法律问题,其中的纠纷不乏由于电子商务...随着我国经济由高速发展转向高质量发展,数字经济也爆发出巨大活力。依托于互联网技术的各类网络第三方平台相继出现并迅速扩张,给市场经济带来井喷式电子商务服务或买卖交易的同时,也引发一系列的法律问题,其中的纠纷不乏由于电子商务平台法律性质模糊、法律义务规定笼统以及法律责任存在争议而产生。因此,本文通过理清电子商务平台与平台内经营者和消费者之间的法律关系,明确电子商务平台的法律性质,以服务合同受托方视角梳理电子商务平台应当承担的危险预防、避免及救助义务,进而明晰电子商务平台怠于履行相应安全保障义务时所须负担的民事责任,以期规范电子商务平台交易,促进数字经济健康发展。As China’s economy has shifted from high-speed development to high-quality development, the digital economy has also exploded with great vitality. Relying on the Internet technology of all kinds of network third-party platform appeared one after another and rapid expansion, to the market economy to bring blowout e-commerce services or trading transactions at the same time, but also triggered a series of legal problems, which disputes due to the e-commerce platform of the legal nature of the fuzzy, the legal obligations of the provisions of the generalization of the legal responsibility of the existence of the controversy and arise. Therefore, this paper clarifies the legal relationship between e-commerce platforms and platform operators and consumers, clarifies the legal nature of e-commerce platforms, comprehends the e-commerce platforms should bear the obligations of danger prevention, avoidance and relief from the perspective of the trustee of the service contract, and then clarifies the civil liabilities of the e-commerce platforms which are required to be borne in case of negligence of performing the corresponding obligations of security, in order to standardize the transactions of e-commerce platforms and promote the healthy development of the digital economy.展开更多

For the purpose of profit-seeking capital, e-commerce platforms have abused algorithms to carry out “big data-driven price gouging” behaviors in an endless stream. In response to the behavior of “big data-driven price gouging”, it is difficult to implement the relevant provisions of China’s existing Civil Code, Price Law, and Anti-Monopoly Law, effectively. Based on this, this paper takes the protection of consumers’ rights and interests as the starting point, and through the combing of “big data ripening” behavioral pattern, summarizes its essence as the infringement of improper use of consumers’ personal information in e-commerce platforms. On this basis, the current dilemma of the “big data ripening” behavior is discussed in depth: the existence of non-legitimacy in some of the format terms and conditions, the controversy over the definition of personal information and the unreasonable distribution of the burden of proof for general infringement, and then the legislation, law enforcement and judicial level, and countermeasures and proposals for the governance of the “big data ripening” behavior are put forward. Then, from the legislative, law enforcement and judicial levels, it puts forward countermeasure suggestions to govern the “big data-driven price gouging” behavior.展开更多
