The current research overlaps a linguistic and a legal analysis of public international law in the Ukrainian case.Based on both official documents and public declarations,it explains the grounds for the wide range of ...The current research overlaps a linguistic and a legal analysis of public international law in the Ukrainian case.Based on both official documents and public declarations,it explains the grounds for the wide range of understandings that the two common concepts-peace and war-may be bearing depending of the angle of looking at the matter and depending on the actor invoking them.The study develops the reasons likely to have been considered by President Putin when insisting to refer to the Russian military action started in Ukraine in February 2022 as“special military operation”instead of“war”and the cardinal difference in terms of legal impact for such a linguistic choice.It also builds on the elements which could serve as a basis for achieving a deal in obtaining peace in Ukraine,while tackling on the possible geopolitical,public communication and diplomatic hurdles,and offering clues for strategic analysis of the matter.展开更多

Through a detailed analysis and documentation of relevant U.S.foreign relations and other official documents of the period around the Korean War,this paper aims to prove that in the early negotiation process of the 19...Through a detailed analysis and documentation of relevant U.S.foreign relations and other official documents of the period around the Korean War,this paper aims to prove that in the early negotiation process of the 1951 San Francisco peace treaty,the United States maintained that South Korea should participate in signing the treaty and that the U.S.changed its position because of the resilient British opposition to South Korean participation,which in turn was motivated strongly by the British concern over its strategic interests in East Asia and its diplomatic relations with the newly communized China.In particular,the Chinese intervention in the Korean War and the communist recapture of Seoul provided the impetus for this shift in the U.S.position that led to the exclusion of South Korea from the treaty.Because the substance of the San Francisco peace treaty was dictated by the exigencies under the Korean War and the Cold War and lacks the“Grotian spirit of international law”underlying the founding of the League of Nations and the United Nations,the San Francisco peace treaty does not contain sufficient merit to be worthy of permanent compliance,which leaves open the possibility of modification in the future.展开更多

Moreover, peace is the most fundamental value in the Qur'an and Islam. The majority of the classical Muslim jurists, especially Hanafi school, emphasised that the reason for Muslims' fight against non-Muslims is Muslims' defense themselves against attacks, not non-Muslims' faith. Bediuzzaman Said Nursi (d. 1960) states that the only kind of jihad that is appropriate for the present age is spiritual or moraljihad. Furthermore, regarding Qur'anic approach to relations between Muslims and the People of the Book, Muslim scholars, in general, advocate sincere relations and trust between Muslims and the People of the Book. In addition, Said Nursi is one of the great Muslim scholars in interfaith dialogue in the 20th century. Finally, there is the need for establishing culture of coexistence, which practised before within a religious tradition such as Islamic tradition for many centuries in the history. During the war, the human rights of Chinese people were completely violated by the Japanese aggressors, causing an unprecedented human rights catastrophe. At the same time, Chinese people vigorously resisted the aggression in order to defend the national survival right and safeguard the human peace against war. The history of human rights’ victory over human rights abuses tells us: aggressive wars are the most serious violations of human rights. We must protect people’s right to peace for every country in the world. In order to avoid violations of human rights by war once again, we must safeguard the international postwar order and prevent the revival of fascism, whose essences are contempt for and trample on human rights. Therefore we have to respect and protect human rights and defend both the collective rights of every nation and the individual rights of every person in the world.展开更多
